Letter to Brian Murtagh from Michael Malley re: Requests for Evidence

October 21, 1975

Brian M. Murtagh, Esq.
Organized Crime and Racketeering Section
Criminal Division
United States Department of Justice
Washington, D.C. 20530

Dear Mr. Murtagh:

This will confirm out telephone conversation of this morning. I plan to be in Washington the morning of Thursday, October 30, to meet with you. At that time I would like to accomplish the following things:

(1) Make arrangements to have duplicated the various blueprints of 544 Castle Drive showing laboratory technicians' markings of various pieces of evidence;

(2) Receive approximately 500 (your count) photographs, purported, to be all the photographs of the crime scene, evidence, etc. As I understand it, you will describe to me the contents of the photographs, when taken, by whom, and we will agree to a numbering system. In addition, you will cross-reference any and all photographs which were introduced into evidence at the Article 32.

As I explained to you, I will not be in any position to enter into any stipulation as to the authenticity or contents of the photographs. However, I would hope that, if your descriptions of the photographs are as accurate as possible, at some future time, we might be able to enter into at least some stipulations regarding at least some of the photographs, based upon your representations.

While I am in Washington, I would hope you would be able to supply me with some of the other materials requested by Mr. Segal, specifically, addresses of the Article 32 witnesses and other persons that we have requested, and all witness statements of persons who appeared before the grand jury and/or persons you have subpoenaed for trial.

Please advise me by phone at Mr. Segal's number if you are unable for any reason to be able to accomplish what I have mentioned above at the time we agreed upon.

Sincerely,

Michael J. Malley
